GENERAL TERMS AND CONDITIONS OF SALE AND USE

1. Definitions

For the purposes of this document:

  • “Website”: www.sabanah.com and all its pages and domain variants (fr.sabanah.com, sabanah.fr, etc.).

  • “Product”: all goods (physical) and services (digital) that can be purchased on the Website.

  • “User”: any internet user browsing the Website.

  • “Customer”: any User purchasing a Product on the Website.

  • “Member”: any User or Customer who has created an account on the Website.


2. Purpose of the Website and Scope of the Terms

The purpose of the Website is:
“the online sale of pet furniture and accessories.”

SABANAH designs and markets luxury furniture and accessories for pets worldwide under the SABANAH brand.

Access to the Website is free. Browsing the Website, creating a Member account, or placing an order implies full acceptance of these Terms.

The present General Terms and Conditions of Sale and Use (“Terms”) govern all relations between SABANAH and any Customer placing an order on the Website.


3. Legal Capacity – Age Requirement

By placing an order, the Customer declares and warrants:

  • that they are a natural person over the age of 18 with full legal capacity,

  • or a legally represented legal entity.

If the Customer is a minor, they declare they have the authorisation of their legal guardian.

SABANAH reserves the right to refuse or cancel any order that appears to have been placed in violation of this requirement.


4. Acceptance of the Terms

When placing an order, the Customer must explicitly check the box:

“I acknowledge that I have read and accepted all terms and conditions of the Website.”

If the Customer goes directly to checkout, clicking “Payment and validation of terms” constitutes acceptance of the Terms.

Checking this box or clicking this button has the same legal value as a handwritten signature.

The Customer acknowledges the evidential value of SABANAH’s electronic records and waives the right to contest them unless proven otherwise.


5. Product Characteristics

All Products offered appear in the online catalogue. Products are offered subject to availability.

Each Product is accompanied by a detailed description.

SABANAH exercises the utmost care in selecting materials and manufacturing the Product.

Product photos and videos reflect the item faithfully but are not contractual, as variations may occur due to:

  • natural materials (wood tone, grain, texture),

  • artisanal manufacturing,

  • size variations,

  • colour nuances,

  • lighting differences (indoor/outdoor, day/night).

Colour rendering may vary according to:

  • device type (PC, smartphone, tablet, TV),

  • screen calibration,

  • display technology.

These variations do not constitute defects or non-conformities.

7. Prices and Eligibility to Purchase

Prices listed on the Website are tax-inclusive (TTC) when displayed in euros.

Prices may vary depending on VAT rates and currency availability for non-EU customers.

The applicable price is the one displayed at the time of the order.

By ordering, the Customer expressly authorises SABANAH to:

  • verify their solvency,

  • transmit or obtain data from third-party credit agencies or anti-fraud agencies,

  • validate the payment instrument.


8. Member Account

Creating an account is required for ordering. The Member is responsible for protecting their password.

SABANAH may suspend or delete accounts:

  • containing false information,

  • violating the Terms,

  • inactive for over 12 months.

Account pages are informative only and not legally binding evidence.


9. Ordering Process

“Basket” refers to the virtual selection of Products chosen for purchase.

Steps:

  1. Add Products to the Basket.

  2. Review order summary.

  3. Accept Terms.

  4. Provide required information.

  5. Proceed to secure payment (card or PayPal).

  6. Receive order confirmation email.

Ownership of the Product remains with SABANAH until full payment is received.


10. Payment

Payments accepted:

  • Visa, MasterCard, American Express, Maestro,

  • other methods indicated on the Website,

  • PayPal where available.

All card payments are processed through a secure encrypted payment gateway (SSL).

SABANAH never stores card details in plain text.

If the card issuer refuses payment, SABANAH cannot be held responsible for delays or failed deliveries.


11. Delivery

Delivery is made to the Customer’s home or business address (excluding P.O. boxes, cafés, restaurants, hotels).

A signature is required upon delivery, transferring responsibility to the Customer.

The Customer must inspect the package and:

  • note written reservations on the delivery slip,

  • open damaged packages in the presence of the courier,

  • notify SABANAH within 24 hours with photos.

Failure to follow this procedure releases SABANAH from liability.

A delay exceeding 7 working days beyond the estimated delivery time may entitle the Customer to cancel the order in writing (registered mail), except in cases of:

  • courier strike,

  • force majeure.


12. Right of Withdrawal (EU Only)

EU Customers may withdraw from their purchase within 14 days, without reason.

They must notify SABANAH:

Return costs are borne by the Customer.

Refund is made within 14 days of either:

  • receiving the returned Product, or

  • receiving proof of shipment.

Bulky goods (wooden baskets “Drôle de Panier”, “Inuit”, “Le Couture”) may incur significant return costs.


13. Return Procedure

a) Withdrawal returns

Customer chooses their own carrier and pays return fees. SABANAH is not liable for lost/damaged return parcels.

b) Returns due to SABANAH (error, non-conformity, defect)

Return costs are paid by SABANAH only if the Customer uses the carrier designated by SABANAH.

c) Return conditions

Products must be returned:

  • unused,

  • complete,

  • in perfect condition,

  • in their original undamaged packaging.

Used, damaged, incomplete or soiled Products will not be refunded.


14. Repeated Returns

SABANAH reserves the right to refuse future orders from Customers who repeatedly return merchandise.


15. Promotional Codes

Promo codes:

  • are non-transferable,

  • cannot be exchanged for cash,

  • cannot be combined with other offers,

  • must be used before expiration.


16. Gift Cards

Gift cards:

  • are valid for 12 months,

  • are non-transferable and non-refundable,

  • can be used to purchase any Product,

  • allow remaining balances to be stored in the Customer's online account.

SABANAH is not responsible for cards sent to incorrect email addresses or for stolen/lost cards.


17. Product Guarantee

Products are covered by:

  • the legal guarantee against hidden defects (French Civil Code art. 1641),

  • the legal guarantee of conformity,

  • any commercial warranty included with the Product.

Warranty does not cover:

  • misuse,

  • non-compliance with instructions,

  • damage caused by animals.


18. Intellectual Property

All content (texts, photos, videos, logos, designs, structures, software) is protected by intellectual property laws and belongs exclusively to SABANAH.

Any reproduction or redistribution without prior written consent is prohibited.

Contributors to the blog or comments section grant SABANAH the right to reproduce and use their contributions, including for commercial purposes.

Brands and logos displayed are registered trademarks of SABANAH.


19. Limitation of Liability

SABANAH is only bound by a best-effort obligation and cannot be held responsible for:

  • internet-related issues (loss of data, hacking, viruses),

  • force majeure,

  • indirect damages (loss of profit, operations, data, customers),

  • incompatibility of the Product with Customer equipment.


20. Website Availability

The Website is accessible 23 hours per day, 7 days per week, except in cases of:

  • maintenance,

  • updates,

  • host intervention,

  • network failure,

  • power outage,

  • force majeure.


21. Cookies

Cookies may be used to:

  • identify Users,

  • personalise navigation,

  • speed up display,

  • ensure security,

  • collect statistics.

22. Account Closure

Customers may close their account at any time by emailing:

Account deletion is irreversible (subject to legal retention obligations).


23. Notifications – Claims

Claims or notifications must be sent:

Claims must be submitted within 365 days of the occurring issue, otherwise they become permanently inadmissible.


24. Applicable Law – Jurisdiction

These Terms are governed by French law.
Unless otherwise required by public policy, disputes fall under the jurisdiction of the competent French Courts.

If a clause is deemed invalid, the remaining clauses continue to apply.
